5 Jun 2010The other week a friend and i were leaving a hotel….i currently dont have a drivers lisence but we were using my fathers truck.(My friend was driving) my friend backed up into a parked car and there is damage done to the passangers side door…The question is do i have to go through my insurance or should he have pay/go through his insurance to pay?

It is your friends fault. You will probably have to go through your dads insurance company. Does your friend have a driver’s license?

Your friend is liable. That’s because it is the driver and not the vehicle that is covered by auto insurance. If he were to rent a vehicle, would the rental companie’s insurance be liable – no (unless he signed up for their coverage). I wouldn’t even tell my insurance company, since they’ll probably raise your dad’s premiums even if they don’t have to pay (anf they won’t have to do so).

Car insurance covers the car so your ins should pay for the damages. But the driver should get a mark on their driving record as well.
Have you not reported the accident yet?
Best bet is to get off of Yahoo Answers and call your insurance company right away.

Your Dads insurance may cover your friend as an authorised driver. Your Dad should ask his insurance agent. Your friend may be covered by his car policy.
Your Dad could sue your friend for damages ( like his deductible or increase in rate) .
Since you dont have a license but had your friend drive your dadas vehicle it sounds like your friend had been authorised to use the truck,
your friend might want to get some legal advice. Hopefully the damage wont be too much .

In your situation both the insurance policies can be applicable.
The driver of the vehicle is Liable for an at fault accident and the owner of the vehicle is liable for any accident involving the legal permissive use of his vehicle.
Your Fathers Insurance, the Insurance on the Vehicle being operated is “Primary” and so long as your friend is not an excluded driver, will pay for any damages up to the policy limit. Most likely the damage you described will be far less than these limits.
Should the actual damages exceed the limits of your fathers policy, then being the driver at the time, your friend’s own auto insurance would be Secondary coverage and kick in and pay for additional damages.
Should the driver learn at some point that the vehicle he was driving had no coverage, then his own auto policy would act as Primary where no other coverage exists and liability is concerned.
An Auto Insurance Policy Is Primary coverage. It follows the Vehicle and The scheduled Drivers.
A Driver or Operators Policy is Secondary coverage when an Auto policy is in place. It acts as Primary liability coverage when no other coverage exists, and it follows the Driver.

Insurance follows the vehicle, not the driver, so it will be your dad’s insurance that will pay for the damages to the other vehicle.
