It’s not illegal persay, depending on the amount of damage.

In most regions, any accident resulting in more than $1000 worth of damage (combined) to the vehicles involved must be reported to the police.

If you are found guilty, you will have a charge against you and may lose points on your license (depending what they charge you with).

That being said, you never *HAVE* to file a claim through your insurance company. They’re essentially there to pay for an accident when you cannot (hence insurance). And though you don’t file the claim through them, they will find out about it when your insurance is renewed since they have your license information anyhow. It’s probably best to just be upfront with them about it even if you don’t plan on making the claim through them.

Nothing, if you can afford to cover all the damages in cash. By not filing a claim, the Insurance company isn’t out any money. But, if they have to shell out money towards repair/replacement, they will usually raise your rates for compensation. Since it depends on the company, you’d get the most accurate answer by calling them and asking a ‘hypothetical’ question. Be anonymous, by not giving your name…

As for the answer I see before mine:
1. Regardless of the total cost in damages, whether an Accident is reported to the Police or not, Insurance companies do not have to be involved! However, if there are (new) points when the Policy renews, the rates usually increase. Those increased rates will not drop, until the Policy renews again, provided there are fewer points at that time.
2. Points are not lost, they are added. 0 is preferable. 12 means Mass Transit.

If you pay the other driver for the damage, etc., you are not required to file a claim.

However, you are required to report the accident to your insurance company. Not REPORTING it might be illegal. Reporting it to the insurance company, without filing a claim is not illegal.
